Here he explains some of the potential pitfalls with Production Insurance and the types of cover available. (This article refers specifically to the industry in the ROI, UK, and EU, and includes information on Drones and Errors and Omissions.) Film Production Insurance – Drone Insurance – Errors & Omissions Cover A brief outline of covers: Film Production Employer Liability: Injuries to the crew, actors were negligence is proven against the production company. Limit of Indemnity: €13M Public Liability: Injuries to Third parties (members of the public) or damage to Third Party property (i.e. locations where you are shooting) – limit of indemnity normally require €6.5/€7.5M – again where negligence is proven against the production company. Equipment: (owned or hired) – camera’s/lighting/sound etc – Theft/damage (excluding equipment left in vehicles overnight) Props/Sets/Wardrobe: Damage/Theft Office Contents: Theft/damage Motor Insurance: (in so far as it related to shooting on a film production) – VERY IMPORTANT – standard production policies exclude cover for vehicles being driven on “OPEN ROADS” where the ROAD TRAFFIC APPLIES – cover must be specifically requested and maybe only available with certain insurers. Loss of filmed content/Negative: cost of re-shoots etc. Extra Expense: additional production costs (following loss/damage of equipment etc) Non Appearance cover: i.e. – failure of main actor/Director etc to appear – death/injury/illness etc. Production money: theft of cash (less of a problem these days with credit cards) Travel Insurance: (to the location) – to be arranged from the country of domicile. Drones: (more and more popular these days) – NB: Cover HAS TO BE requested – Damage to the Drone itself and/or liability arising out of injury to third parties or third-party property arising out of the use of the drone. Errors & Omissions Cover Subject to content of script etc being legally reviewed by a MEDIA lawyer in respect of Title, defamation issues, use of shots of public/private locations, music copyright, etc. Normal limits of cover required – Limit of indemnity: €1,000,000 (€3,000,000 in aggregate) term of policy 3 years (can be a higher limit and longer-term). Errors and Omissions should be carried from the start of production, but will be insisted on by Third Parties providing funding to the production. The above is only to be used as a helpful guide and not to be taken as the “Gospel”. I have tried not to overload with technical jargon, but to give some idea of the covers that can be provided.
